I hereby acknowledge receiving the above described animal(s) from Pet Owner, Current Care Giver, Shelter, Rescue Group or Other, hereinafter referred to as Pet Provider. I hereby agree to be bound by the following terms and conditions:
Foster Pet Guardian understands that the animal(s) shall remain the sole property of Pet Provider, Pet Allies, Inc., of Show Low, Arizona, and that Foster Pet Guardian shall be required to return this animal to Pet Provider on demand. I, as Foster Pet Guardian, agree to return said animal(s) upon request, or at the expiration of the above time period, or if I am no longer to care adequately for them.
Foster Pet Guardian understands that he/she will be considered by Pet Provider before all others for adoption of this animal if Pet Provider decides to place this animal for adoption. Foster Pet Guardian further understands that Pet Provider shall have sole discretion to decide the placement of this animal for adoption.
I, as Foster Pet Guardian, agree to provide the animal(s) with good and loving care, including but not limited to sufficient food, water, shelter, and medication when required. Foster Pet Guardian will provide said services The Foster Pet Guardian will at all times respect and treat the pet humanly and will not cause harm, restrict the pet unnecessarily, or put the pet in danger of any kind.
Pet Provider should provide a dog license (when applicable) and the Forster Pet Guardian is responsible for the license be worn at all times.
Foster Pet Guardian will ensure that all home windows, regardless of location or height, will be safe.
Foster Pet Guardian will abide by all laws and ordinances concerning the humane treatment of animals.
Foster Pet Guardian will keep this animal solely as a companion and not allow this animal to be used for medical or other experimental purposes.
Foster Pet Guardian will notify Pet Provider immediately if the Foster Pet Guardian has a change of address or telephone number.
Foster Pet Guardian shall notify Pet Provider by telephone immediately if this animal becomes lost or stolen. Foster Pet Guardian further agrees to make every effort to recover this animal, by visiting local animal shelters and by posting signs and advertising in local newspapers. If this animal has been impounded, Foster Pet Guardian will pay the redemption fees and redeem this animal or notify Pet Provider immediately of this animal's whereabouts.
Foster Pet Guardian agrees to allow representatives of the Pet Provider to make periodic inspections of this animal and the living conditions provided for this animal.
Foster Pet Guardian agrees that Pet Provider shall have the right, in its sole discretion, to terminate this agreement at any time, reclaim this animal and exercise all of the other rights and remedies provided herein and at law and in equity.
If Foster Pet Guardian has other pets at home, Foster Pet Guardian attests to the fact that all of his/her animals are current on their vaccinations. Foster Pet Guardian fully and completely releases Pet Provider, its directors, officers, employees, agents, and servants from any claim, cause of action or liability for any illness Foster Care Guardian's other animals may develop, even if said illness may have been procured from this foster care animal.
Foster Pet Guardian understands that Pet Provider does not guarantee the health, training, or temperament of the animals it places for foster care. Foster Pet Guardian further understands that while Pet Provider takes reasonable care to prescreen the animals it places in its Foster Care Program, foster care pets can be incubating an illness that does not display signs until a later time.
Foster Pet Guardian freely and completely releases Pet Provider, its directors, officers, employees, agents and servants, from any claim, cause of action or liability for any defects or illnesses this animal may have or develop and to indemnify and hold Pet Provider, its directors, officers, employees, agents and servants harmless against all claims, causes of action, or liability, including, but not limited to, those asserted by third persons, for any injury, death, or damage to persons, animals, or property caused or alleged to be caused by this animal.
Foster Pet Guardian agrees to reimburse Pet Provider for any and all legal fees and court costs it incurs in enforcing the terms and conditions of this agreement.
Foster Pet Guardian agrees to pay Pet Provider the sum of $500 as liquidated damages in the event the terms of this agreement are breached. Foster Pet Guardian agrees that in addition to the collection of such liquidated damages, Pet Provider shall retain all of the other remedies, including, but not limited to, the inspection and reclaiming of the animal, provided for in this agreement and allowed at law or in equity.
Foster Pet Guardian certifies that all information attached hereto is true.
No modification to this agreement shall be effective unless in writing signed by the Foster Pet Guardian and authorized representative of Pet Provider.
This agreement shall be governed by the laws of the State of Arizona, County of Navajo.
In the event that any term, provision or paragraph of this agreement is or is declared illegal, void or unenforceable, this shall not affect or impair the other terms, provisions, or paragraphs of this agreement. The doctrine of severability shall be applied.
